Terms such as legal suite, registered suite, illegal suite, in-law suite and developed basement are not interchangeable. Calgary buyers should verify documents instead of assuming that a kitchen and separate entrance establish legal rental status.

What a secondary suite means in Calgary
The City of Calgary defines a secondary suite as a self-contained residence within a home, generally including cooking, bathroom, sleeping and living facilities with appropriate access. Legal and safe suites are connected to permits, inspections and the City’s Secondary Suite Registry.

Legal, registered and permitted
A listing may use “legal suite” to indicate that required approvals were obtained. Buyers should still search the registry, request permit history and confirm that the existing layout matches approved plans. Registration attaches to the address, but later alterations can require additional permits.
Illegal or unauthorized suite
An illegal suite may contain many features of a separate dwelling but has not completed the required approval and inspection process. It should not be valued as guaranteed rental income. Legalization may require construction, professional drawings, permits, inspections or changes to windows, fire separation, ventilation, electrical, plumbing, parking or access.

In-law suite and mother-in-law area
These are common marketing descriptions, not automatic legal classifications. They often refer to private space for relatives and may include a bathroom or kitchenette. Ask whether the area is intended for internal family use, whether cooking facilities are permitted and whether it appears on approved plans.
Developed or finished basement
This normally means the lower level has finished rooms. It does not promise a legal secondary dwelling. A developed basement can still offer excellent value as guest space, bedrooms, recreation, storage or a home office.

Questions for your realtor and lawyer
Ask whether the suite appears in the registry, what permits were issued, whether there are outstanding compliance matters, how the property is insured, whether the lender accepts the proposed use and whether any tenancy exists. Include suitable conditions in the purchase contract when these facts matter to your decision.
Do not calculate rent until verification is complete
Projected rent can make a property look more affordable, but vacancy, utilities, maintenance, taxes, insurance and legal compliance affect the real outcome. Treat all income figures as scenarios rather than promises.
